... Gabriel admitted he had regularly placed piles of apples near his home in order to feed "wildlife." The apples were not near the treestand located near the house in which Gabriel lives, so he was not baiting deer for hunting purposes.  In 2009, Gabriel was fined by Sullivan Judge Kathryn Sweeney for violating state Department of Environmenal Conservation regulations for feeding deer... In his overturning the conviction, LaBuda ruled that the state law was too vague and, more importantly, violated Gabriel's free speech rights.
